Ayala v. Holder, 08-71868
In a petition for review of an order of the BIA affirming the denial of petitioner's applications for asylum, withholding of removal, and protection under the CAT, judgment of the BIA is affirmed where prior service in the military does not constitute membership in a particular social group, such that petitioner's fear of reprisals from criminal elements in El Salvador because of his previous service as a military officer provided grounds to grant his petition under the INA.
