Kemp v. Ryan, 08-99030

In a petition for habeas relief on the grounds that trial court admission of incriminating statements as well as a prior homosexual assault without voire dire of the jury to determine bias following a denial of discovery request were reversible errors, judgment denying petition is affirmed because petitioner failed to show that the Arizona Supreme Court’s opinion affirming his conviction and capital sentence was either an unreasonable application of, clearly established Federal law, or an unreasonable determination of the facts, as required under 28 U.S.C. section 2254.
