United States Ninth Circuit

Conviction and sentencing of defendant on firearm and drug-related charges is upheld where: 1) under FRCP 32(e)(3), post-revocation sentencing recommendations must be disclosed unless the district court directs otherwise; 2) Rule 32(e)(3) comports with the Equal Protection Clause; and 3) the district court complied with the sentencing requirements of United States v. Baldrich.
