Singh v. Holder, 10-15715

In a dispute involving the applicable standard in a Casas hearing, judgment of the district court is affirmed in part and vacated in part because the government must prove by clear and convincing evidence that continued detention of petitioner, a Fijian national, is justified and that the immigration court is required to make a contemporaneous record of Casas hearings where an audio recording would suffice.
