Trishan Air, Inc. v. Fed. Ins. Co., 09-55317

In an aviation insurance coverage dispute arising out of a jet accident in which the pilot had not undergone the training mandated by the policy's pilot warranty, summary judgment to insurer-defendant is affirmed where plaintiffs failed to raise a material issue of fact regarding strict compliance with the pilot warranty, breach of the implied covenant of good faith and fair dealing, or bad faith. In addition, plaintiffs' claim for coverage under Coverage 29 of the policy was not properly raised in the district court.
