Fabrini v. City of Dunsmuir, 09-16292
In a section 1983 claim for malicious prosecution and a state law defamation claim, brought by a man sued by the City of Dunsmuir, California, for his failure to sufficiently collateralize a municipal loan, the district court's award of attorney's fees to the City on the basis of its successful anti-SLAPP motion, and grant of summary judgment in favor of the City as to the section 1983 malicious prosecution claim, are affirmed as to the 1983 ruling, and vacated as to the attorney fees.
