In an action claiming that plaintiff was fired in retaliation for giving truthful subpoenaed testimony in a criminal proceeding, the district court's grant of summary judgment to defendant based on qualified immunity is reversed where plaintiff’s First Amendment interests outweighed the administrative interests of the governmental entity with which defendant was affiliated, and his rights were clearly established at the time of the alleged violation.
