US v. Vela, 08-50121

In a prosecution for assault on a federal officer, the jury's verdict finding defendant not guilty by reason of insanity is affirmed where: 1) defendant's arguments were foreclosed by the Ninth Circuit's decision in United States v. Jim, 865 F.2d 211 (9th Cir. 1989), where the court held that 18 U.S.C. section 111 was a general intent crime; and 2) section 111 did not violate Apprendi.
