United States Ninth Circuit

Sapp v. Kimbrell, 05-15745

In an action by a prisoner alleging improper treatment of his eye condition, dismissal of the complaint for failure to comply with the Prison Litigation Reform Act is affirmed where, although improper screening may excuse a failure to satisfy the PLRA's exhaustion requirement, the facts did not show that prison officials improperly screened out plaintiff's administrative grievances.
