Pit River Tribe v. US Forest Serv., 09-15385
In an action by an Indian tribe against various agencies alleging that they violated various federal environmental laws during the leasing and development process regarding the development of a geothermal power plant, summary judgment for defendants is affirmed in part where the district court did not abuse its equitable powers in ordering that the original 1988 leases be treated as capable of extension. However, the judgment is reversed in part with instructions to correct an inconsistency in the district court's order.
