United States Ninth Circuit
Sneller v. Bainbridge Island, 09-35056
In plaintiffs' appeal from a sanction award to defendants under Federal Rule of Civil Procedure 11 and 28 U.S.C. section 1927, the order is reversed where the imposition of the sanction was error because plaintiffs effectively withdrew any claims that violated Rule 11(b) during the safe harbor period, before defendants filed their motion for sanctions.
