Zobmondo Ent'mt., LLC v. Falls Media, LLC, 08-56831

In an action for trademark infringement, unfair competition, and related claims based on plaintiff's use of defendant's registered trademark "WOULD YOU RATHER . . . ?", summary judgment for plaintiff is reversed where there was a genuine issue of material fact whether "WOULD YOU RATHER . . . ?" was merely descriptive.
