Noel v. Hall, 06-35730
In an action alleging violation of federal wiretap laws, summary judgment for Defendant is affirmed, where 1) Defendant did not "intercept" Plaintiff's phone conversation under 18 U.S.C. section 2511(1)(a) when she listened to a recording of it and made a copy; and 2) Plaintiff had no claim for the disclosure of the conversation because Defendant did not unlawfully intercept it.
