United States Ninth Circuit

Torres-Chavez v. Holder, 05-72226

In a petition for review of the BIA's order removing Petitioner from the U.S., the petition is denied where Petitioner's Due Process rights were not violated by his lawyer's performance, because a lawyer in counsel's position could have reasonably made the tactical decision to concede his client's alienage.
