In a Federal Tort Claims Act (FTCA) action for medical malpractice, the dismissal of the complaint is affirmed where the FTCA statute of limitations is jurisdictional and, consequently, equitable doctrines that otherwise could excuse a claimant's untimely filing do not apply.
