United States Ninth Circuit

Browning v. US, 07-35557

In an employment discrimination action alleging retaliation for filing an Equal Employment Opportunity complaint, judgment for Defendant is affirmed, where, so long as the jury instructions set forth the essential elements a plaintiff must prove, a District Court does not abuse its discretion in declining to give an instruction explicitly addressing pretext.
