In an action seeking overtime pay, the Court of Appeals certified the following questions to the Supreme Court of California: 1) whether a pharmaceutical sales representative is an "outside salesperson" under 8 Cal. Code Regs. section 11010; and 2) whether such a person customarily uses discretion under 8 Cal. Code Regs. section 11040.
