United States Ninth Circuit

Davis v. HSBC Bank Nevada, N.A., 08-57062

In an unfair competition action, the District Court's order remanding the case to state court is reversed, where 28 U.S.C. section 1332(d)(4) did not preclude subject matter jurisdiction under the Class Action Fairness Act because Defendant-Best Buy did not have its principal place of business in the forum state of California.
