In a breach of contract action, the District Court's dismissal is reversed and remanded. The Carmack Amendment governed Defendants' liability for the railroad accident at issue, and 49 U.S.C. section 10502 controlled whether the parties effectively contracted out of the Carmack Amendment's default venue restrictions.
