Dawson v. Marshall, 06-56454

Dismissal of a petition for habeas corpus is affirmed where the ruling on the petition by an Article III judge who had issued findings and recommendations on the case in his prior capacity as a magistrate judge violated no law and denied petitioner no right. The panel recommends, however, that the district courts avoid assigning new district judges to cases they handled as magistrates.
