Zucco Partners, LLC v. Digimarc Corp., 06-35758
In a suit alleging that a company and two of its officers violated sections 10(b) and 20(a) of the Securities Exchange Act of 1934 and the regulations promulgated thereunder, including Rule 10b-5, dismissal of the complaint is affirmed where the Supreme Court's decision in Tellabs, Inc. v. Makor Issues & Rights, Ltd., 127 S. Ct. 2499 (2007) did not materially alter the particularity requirements for scienter claims established in previous Ninth Circuit decisions, and plaintiff failed to adequately plead a strong inference of scienter.
