United States Ninth Circuit

US v. Collins, 06-50339

Conviction for conspiracy to possess with intent to distribute and to distribute methamphetamine and possession of methamphetamine is reversed in part where the district court applied an improper standard by requiring defendant to demonstrate a pattern of strikes against a cognizable racial group before requiring the government to state a reason for a peremptory strike, but affirmed in part over defendant's challenges to the suppression of an audiotape recording of a government informant and the court's refusal to require the government to accept a subpoena for a confidential informant.
