Vaughn v. Bay Env't Mgmt., Inc., 05-17100

In an ERISA case, dismissal for lack of jurisdiction is vacated and the case remanded, where: 1) plaintiffs who have already received payout from defined contribution plans are "participants" under ERISA section 502; and 2) the additional amount participants would have received from a defined benefits plan but for breach of fiduciary duty are "vested benefits" which plaintiffs can recover.
