Blazevska v. Raytheon Aircraft Co., 06-16028
In a wrongful death action against a plane manufacturer brought by family members of eight Macedonian residents, including the Macedonian president, who died in a plane accident in Bosnia in 2004, summary judgment for defendant is affirmed where: 1) the presumption against extraterritoriality is not implicated in this case; and 2) thus, plaintiffs' action was barred by the eighteen-year statute of repose in the General Aviation Revitalization Act of 1994 (GARA).
