US v. Rodriguez, 07-10217

The "clear statement" rule of Davis v. US, 512 U.S. 452, 462 (1994), applies only after the police have already obtained an unambiguous and unequivocal waiver of Miranda rights. Prior to obtaining such a waiver, however, an officer must clarify the meaning of an ambiguous or equivocal response to the Miranda warning before proceeding with general interrogation.
