In a suit brought under the Sherman and Clayton Acts for antitrust violations, alleging defendants conspired with each other to set the fees charged to merchants, such as plaintiffs, for payment of credit card sales, dismissal of the action is affirmed where plaintiffs' First Amended Complaint failed to plead evidentiary facts sufficient to establish a conspiracy.
