Lowden v. T-Mobile USA, Inc., 06-35395

In a class action brought by two consumers of T-Mobile's cellular phone service raising contract and state consumer protection law claims, denial of T-Mobile's motion to compel arbitration is affirmed where: 1) the decision in Scott v. Cingular Wireless, 161 P.3d 1000 (Wash. 2007), established that T-Mobile's arbitration provision was substantively unconscionable and unenforceable under Washington state law; and 2) in light of Shroyer v. New Cingular Wireless Servs., Inc., 498 F.3d 976 (9th Cir. 2007), there is no federal preemption.
