A decision affirming U.S. Citizenship and Immigration Services' (CIS) denial of plaintiff's application to adjust his status from a B-2 tourist visa to an H-1B visa for specialty occupation workers is affirmed over claims that: 1) CIS's use of an internal memorandum interpreting a regulation violated the notice and comment requirements of the APA; and 2) CIS's interpretation of the regulation contradicts the language of the regulation.
