Jennings v. Mukasey, 05-16869

ATF's denial of petitioners' application for renewal of their federal firearms license is affirmed where: 1) an "expungement" provided under California law did not eliminate petitioner's prior California conviction of a misdemeanor crime of domestic violence; and 2) thus, the ATF properly relied on the prior conviction and a failure to disclose that conviction on the license renewal questionnaire to deny the application.
