US v. Moreland, 05-30541

A conviction, sentence, and restitution order for mail and wire fraud, money laundering, and conspiracy to commit those offenses are affirmed over claims of error regarding: 1) whether defendant involuntarily waived his right to counsel and received ineffective assistance of counsel; 2) failure to grant an adequate continuance; 3) prosecutorial misconduct; 4) sufficiency of the evidence; 5) whether the sentence was unreasonable; and 6) whether imposition of restitution of over $36 million was error due to the lower court's failure to comply with the time frame outlined in section 3664(d)(5) of the Mandatory Victims Restitution Act.
