United States Ninth Circuit

Sekiya v. Gates, 06-15887

In an action claiming that plaintiff's supervisor discriminated against her on the basis of her disability, in violation of the Rehabilitation Act, the appeal from summary judgment for the employer is dismissed where appellant's opening brief was so deficient that the circuit court was compelled to strike it in its entirety. Despite the dismissal, the court indicates that the case also failed on the merits.
