United States Ninth Circuit

Wah Chang v. Duke Energy Trading & Mktg., LLC, 05-55367, 05-55369

In an electricity purchaser's action against energy companies arising out of the energy crisis of 2000-2001, and seeking to recover damages because of the difference between the rate it was actually charged for electricity and the allegedly fair rate, dismissal of the action is affirmed as the filed rate doctrine barred the action.
