Gardner v. UICI, 06-55045

In an action against defendants raising numerous causes of action based on the sale of the health insurance coverage, an award of fees and costs to plaintiff imposed after the case was remanded to the state court from which it was removed by defendant, is reversed as defendant had an objectively reasonable basis for removal.
