In an action brought under the Northwest Power Act by publicly owned utilities operating in the Pacific Northwest challenging contract amendments entered into between the Bonneville Power Administration and several investor-owned utilities, the case is remanded to the BPA as the circuit court could not determine how the BPA will treat the amendments in light of its decision in Portland Gen. Elec. Co. v. BPA, ___ F.3d ___ (9th Cir. 2007).
