United States Ninth Circuit

Paul Revere Ins. Group v. US, 05-56642

In proceedings arising when the government filed, and then executed in federal court on, a judgment lien against an award defendant recovered for unpaid disability income, a ruling ordering the government's lien enforced is reversed where federal property exemptions do not override California's property exemptions which explicitly exempt defendant's disability income from the judgment lien because: 1) the government chose to use California execution law; and 2) federal law did not preempt this state law on execution.
