Webb v. Smart Document Solutions, LLC, 05-56282

For purposes of an individual's right under the Health Insurance Portability and Accountability Act (HIPAA) to obtain copies of his medical records at a reasonable cost-based rate, as opposed to a higher rate that may be charged to third-parties, HIPAA regulations require the reduced rate only when the individual himself requests the records, and an individual's law firm acting as his agent is not entitled to that same reduced rate.
