US v. Lambert, 07-30060

A sentence imposed following defendant's guilty plea to conspiracy to defraud the U.S. is affirmed where: 1) defendant's conduct, in misrepresenting that he had submitted grant applications on the Education Department's behalf and receiving payment, falls within the plain language of U.S.S.G. section 2B1.1(b)(8)(A); and 2) thus, the district court did not abuse its discretion in applying the enhancement.
