Payan v. Aramark Mgmt. Servs. Ltd. P'ship, 05-15978

Dismissal of a Title VII claim is affirmed where, in the absence of evidence of actual receipt of an EEOC right-to-sue letter, the court will apply a three-day mailing presumption to determine notice of a right-to-sue letter, which rendered the plaintiff's claim untimely.
