US v. Sperow, 05-30483

Conviction for possession of marijuana with intent to distribute is affirmed over defendant's argument that the postindictment delay in his arrest amounted to a violation of his Sixth Amendment right to a speedy trial. Defendant's sentence is vacated, however, where the government fatally compromised its notice of a proposed sentence enhancement.
