United States Ninth Circuit

US v. Strong, 06-10566

In the context of commitment orders, 18 U.S.C. section 4241(d) comports with the Due Process Clause of the Constitution. A claim, that the section is unconstitutional because it requires mandatory confinement without giving the district court an opportunity to assess a defendant's individualized circumstances, is rejected.
