Fernandez-Ruiz v. Gonzales, 466 F.3d 1121 (9th Cir. 2006), abrogates previous applicable precedent such that California Penal Code section 246, which involves the malicious and willful discharge of a firearm at designated inhabited, or occupied, structures or vehicles, is no longer a categorical crime of violence under U.S.S.G. section 2L1.2.
