US v. Grisel, 05-30585
Second-degree burglary under Oregon law is not a categorical burglary for purposes of the Armed Career Criminal Act (ACCA) because it encompasses crimes that fall outside the federal definition of generic burglary. US v. Cunningham, 911 F.2d 361 (9th Cir. 1990), which held that second-degree burglary under Oregon law is a categorical burglary offense under the analysis required by Taylor v. US, 495 U.S. 575 (1990), for purposes of applying the Armed Career Criminal Act (ACCA), was wrongly decided and is expressly overruled.
