US v. Trimble, 06-30298

In a case arising from circumstances in which plaintiff was issued several traffic tickets on a military base, a judgment dismissing some citations and imposing a twenty-five dollar processing fee for three of the remaining ones is reversed where: 1) the only reason plaintiff was charged the processing fee was because she received a new version of the citation notice, while others who were also cited for the same violation on the same date were not charged the fee because they received an older version of the notice; and thus, 2) a magistrate judge violated plaintiff's constitutional rights by charging her more than other petty offenders for offenses covering the same time period.
