Gama Puga v. Chertoff, 05-16902

In an action arising from removal proceedings, dismissal of Mexican citizen's habeas petition for lack of jurisdiction under the REAL ID Act is affirmed on the grounds that petitioner failed to exhaust the administrative remedies that were available to him, and thus his claim was not properly before the district court.
