Orkin v. Taylor, 05-55364
In an action brought by descendants of a Jewish art collector claiming that she was wrongfully dispossessed of a van Gogh painting during Hitler's Nazi regime, entitling them to ownership of the painting, which was later purchased by actress Elizabeth Taylor, dismissal of the complaint is affirmed as: 1) the Holocaust Victims Redress Act does not create a private right of action; and 2) plaintiffs' state law claims were barred by the statute of limitations.
