United States Ninth Circuit
US v. Cabaccang, 05-10352
Convictions and sentences on charges relating to a drug ring that involved the shipment of methamphetamine from California to Guam and its distribution in Guam are affirmed over claims that: 1) the district court did not have jurisdiction over a particular count and therefore erred in reinstating his conviction on that count upon remand; 2) even if the district court did not err in reinstating the conviction, the court erroneously relied on jury findings relating to another count in imposing the sentence; 3) certain sentence enhancements were erroneously imposed; and 4) an inadequate explanation on the sentence was provided and it was unreasonable.
