United States Ninth Circuit
US v. Almazan-Becerra, 05-10056
A sentence for illegal reentry following deportation is vacated where: 1) the district court abused its discretion by applying a twelve-level enhancement for defendant's 1998 conviction; and 2) defendant's disjunctive guilty plea to a 1995 conviction did not "unequivocally establish" that he committed a drug trafficking crime.
