Lands Council v. Martin, 06-35781

Denial of a preliminary injunction to halt implementation of U.S. Forest Service post-fire logging sales in a national forest is affirmed in part and reversed in part as the district court: 1) did not abuse its discretion in denying a preliminary injunction on environmental organizations' claims under the National Environmental Policy Act (NEPA); but 2) applying an erroneous legal standard in denying a preliminary injunction on claims under the National Forest Management Act (NFMA).
