Myron v. Terhune, 04-15770
A district court's sua sponte dismissal of plaintiff's 42 U.S.C. section 1983 prison condition claims is affirmed where: 1) classification of plaintiff at a "level IV" prison rather than at a "level III" prison did not present an "atypical and significant hardship" for purposes of creating a liberty interest protected under the Fourteenth Amendment; 2) a California regulation governing prison publications does not create a liberty interest; and 3) plaintiff's classification did not violate the Eighth Amendment.
