US v. Gonzalez-Perez, 05-10693

A district court's imposition of a 16-level enhancement, and a sentence for illegal re-entry following deportation, are reversed and vacated, respectively, where the district court erred when it applied the sentencing enhancement predicated upon a determination that defendant's conviction for false imprisonment under Florida law constituted a crime of violence under U.S.S.G. section 2L1.2(b)(1)(A)(ii).
